1. Overview
Michelangelo Media AS (Org. no. 935 656 273) operates the Gandrud Visuals brand and the website and online store at gandrudvisuals.com (“Gandrud Visuals”, “we”, “us”, “our”).
These Terms of Service (“Terms”) govern your use of our website, store, digital products, physical products and related services (collectively, the “Services”).
Our online store is hosted by Shopify, which provides the ecommerce platform we use to offer our products and Services.
By using the Services or placing an order, you agree to these Terms together with any policies referenced in them, including our Privacy Policy and Return & Refund Policy.
Nothing in these Terms limits any mandatory rights you have under applicable consumer law.
2. Eligibility and Account Information
You must have the legal capacity required to enter into a binding agreement in your country of residence. If you do not, you may use or purchase through the Services only with the involvement or consent of a parent or legal guardian where required by law.
When placing an order or creating an account, you agree to provide accurate and current information.
You are responsible for keeping any account credentials secure and for activity carried out through your account.
3. Our Products
Gandrud Visuals currently offers products including:
- PDF photography guides
- Lightroom presets
- photographic prints
- other photography-related products, content or services we may introduce
We aim to describe and display our products as accurately as possible.
Photographs, colours and other visual representations displayed on screens may vary slightly depending on screen calibration, device settings, printing processes, paper and lighting conditions. Such normal variations do not affect any statutory rights you may have where a product does not conform to the agreement.
Results from Lightroom presets will also vary depending on the photograph, camera, lighting conditions, colour profile and editing choices.
We may update our product range, availability and product descriptions from time to time.
4. Orders and Contract Formation
Please review your order carefully before submitting it.
When you submit an order, you agree to purchase the selected products at the price and on the terms presented to you at checkout.
We will send an order confirmation to the email address you provide.
An order may be cancelled or corrected where there has been an obvious pricing, technical or product-information error, where payment cannot be authorised, where fraud or misuse is reasonably suspected, or where we are otherwise permitted to do so by applicable law.
Any statutory cancellation or withdrawal rights you have remain unaffected and are described further in our Return & Refund Policy.
5. Prices and Payment
The total price payable for your order will be displayed before you submit the order.
This will include applicable taxes and other charges that we are required to collect, as well as any shipping costs where applicable.
You agree to provide accurate payment information and confirm that you are authorised to use the payment method provided.
Prices and promotions may change from time to time. Changes do not affect orders already placed except where permitted by applicable law or where there has been an obvious error.
Consumer-facing pricing must clearly communicate the total amount payable, including taxes and applicable charges.
6. Digital Products and Delivery
Digital products may include PDF guides, Lightroom presets and other downloadable content.
After successful purchase, digital products may be made available:
- directly from your order confirmation or order status page
- through a download link sent by email
- through another digital delivery method described at checkout
You are responsible for providing a correct email address and using reasonably compatible hardware and software.
Relevant compatibility or technical requirements for a digital product will be described on the product page or accompanying product information where applicable.
If you have problems accessing a digital purchase, contact us at hello@gandrudvisuals.com and we will help resolve the issue.
Digital products supplied to consumers are also subject to mandatory rights under applicable law. Under Norwegian law, for example, the digitalytelsesloven provides mandatory rights relating to delivery, conformity and remedies and cannot be contracted away to the consumer's disadvantage.
7. Physical Products and Delivery
Physical products, including photographic prints, may be produced and fulfilled with the assistance of third-party printing, fulfilment and logistics providers.
Estimated production and delivery times are estimates unless a specific delivery date has been expressly agreed.
You are responsible for providing a complete and accurate shipping address.
If an order is delayed, damaged, defective, lost or incorrect, please contact us at hello@gandrudvisuals.com.
Your rights in relation to delivery, defects, returns and statutory withdrawal are governed by applicable law and our Return & Refund Policy.
Nothing in these Terms limits the rights available to consumers under applicable consumer-sales legislation. Under Norwegian law, the forbrukerkjøpsloven is mandatory in favour of consumers.
8. Returns, Refunds and Right of Withdrawal
Returns, refunds and withdrawal rights are governed by our Return & Refund Policy and applicable law.
Our Lightroom presets are currently covered by a voluntary 14-day money-back guarantee, as described in that policy.
PDF guides are not covered by that voluntary guarantee. However, customers may have statutory withdrawal rights depending on their location and the circumstances of the purchase.
Physical products may also be subject to statutory withdrawal and return rights.
Nothing in these Terms or our Return & Refund Policy limits mandatory consumer rights.
9. Licence for Digital Products
When you purchase a digital product, you receive a limited, non-exclusive and non-transferable licence to use it subject to these Terms.
Photography guides
Photography guides are licensed for your own learning and reference.
You may apply the knowledge, techniques and ideas you learn from a guide to both personal and professional photography.
You may not copy, upload, reproduce, redistribute, share, resell or make the guide or substantial parts of it available to others without our prior written permission.
Lightroom presets
You may install and use purchased Lightroom presets on photographs that you own or are authorised to edit, including photographs created as part of professional or client work.
You may not:
- share or distribute the preset files
- resell or sublicense the preset files
- upload the preset files for public or third-party access
- include the preset files in another product, bundle or download
- claim the preset files themselves as your own
The licence applies to the digital product files themselves. It does not restrict your ownership or permitted use of photographs you create or edit using the product.
10. Intellectual Property
Unless otherwise stated, the Services and their content—including photographs, guides, preset files, text, graphics, videos, branding, logos, illustrations and design—are owned by or licensed to Michelangelo Media AS and are protected by applicable intellectual-property laws.
Purchasing a product does not transfer ownership of our underlying intellectual property except for the limited licence expressly granted in these Terms.
You may not reproduce, scrape, distribute, sell, republish or commercially exploit protected content from our Services without permission except where permitted by law.
You may not use our downloadable products or substantial protected content to build or distribute datasets, competing products or training materials for automated systems without our prior written permission.
11. Reviews, Feedback and User Submissions
We welcome feedback about our products and Services.
If you submit a review, testimonial or other content through a feature clearly intended for public display, you grant us a non-exclusive, worldwide and royalty-free licence to display, reproduce and share that content for purposes reasonably connected with operating and promoting Gandrud Visuals.
You represent that you have the necessary rights to submit that content.
Private communications, customer-support messages and other material not submitted for public display will not be treated as testimonials or public marketing content solely because they were sent to us.
12. Third-Party Services and Links
The Services may contain links to or integrations with third-party services.
We are not responsible for the content or practices of third-party websites or services that we do not control. Your use of those services may be governed by their own terms and privacy policies.
Our use of a third-party service does not remove any responsibility that Gandrud Visuals has towards you under applicable consumer law.
13. Shopify
Our online store is powered by Shopify.
Your purchase of Gandrud Visuals products is made from Michelangelo Media AS, not from Shopify, unless expressly stated otherwise.
Shopify and services such as Shop or Shop Pay may have their own terms and privacy policies governing the services they provide directly to you.
14. Prohibited Uses
You may not use the Services:
- for unlawful, fraudulent or malicious purposes
- to infringe our intellectual-property rights or the rights of others
- to distribute or resell digital products contrary to the licence granted above
- to attempt to gain unauthorised access to accounts, systems or restricted content
- to transmit malware or other harmful code
- to collect personal information unlawfully
- to scrape, systematically extract or reproduce substantial protected content without permission
- to interfere with the security or proper functioning of the Services
We may restrict or terminate access where reasonably necessary to address serious misuse or violations of these Terms.
15. Accuracy and Availability of the Services
We aim to keep our website, product information and Services accurate and available.
Occasionally, the website may contain errors or experience interruptions, maintenance or technical problems.
We may correct obvious errors and update information where reasonably necessary.
Nothing in this section limits your rights where inaccurate information forms part of your purchase agreement or where a purchased product or service does not meet requirements imposed by applicable consumer law.
16. No Guarantee of Photography Results
Photography and editing are creative activities, and results vary depending on factors including experience, equipment, photographs, lighting, software and personal choices.
Examples shown in our guides, presets, website or marketing materials are illustrative and do not guarantee that you will achieve identical results.
This does not affect any statutory requirement that the digital or physical product itself conform to its description and applicable law.
17. Liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, or any remedies available to consumers under mandatory law.
To the extent permitted by applicable law, we are not responsible for losses that:
- were not reasonably foreseeable when the agreement was entered into
- result from circumstances attributable to you
- arise from use of the Services contrary to these Terms or supplied instructions
- relate to business losses where you purchase primarily for commercial purposes
This section does not affect any mandatory rights relating to defective products, delayed delivery, digital content or other consumer claims.
18. Privacy
Our collection and processing of personal information is described in our Privacy Policy.
Where Shopify, payment providers or other third-party services process information in connection with the Services, their own privacy terms may also apply.
19. Governing Law and Disputes
These Terms are governed by Norwegian law.
If you are a consumer, this choice of law does not deprive you of mandatory consumer protections that apply to you under the law that would otherwise govern your purchase.
For EU consumer contracts, a contractual choice of law cannot remove mandatory consumer protections available under the law that would otherwise apply.
If a dispute arises, please contact us first at hello@gandrudvisuals.com so that we can try to resolve it directly.
Norwegian consumers may also be able to submit eligible disputes to Forbrukertilsynet for mediation. Forbrukertilsynet handles disputes between consumers and businesses relating to purchases of goods and services.
Any legal proceedings will be brought before a court with jurisdiction under applicable law. Nothing in these Terms requires a consumer to bring proceedings exclusively before the courts in Oslo where mandatory law gives the consumer another right.
20. Changes to These Terms
We may update these Terms from time to time to reflect changes to our products, Services, business practices or applicable law.
The latest version will be published on this page together with the updated date.
Changes will generally apply to future use of the Services and future purchases. We will not retroactively reduce rights attached to a completed purchase unless permitted by applicable law.
21. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
